There was no justification for removing the video. I used 18 seconds of audio, more...with one still frame in order to comment on an extremely serious matter where the President of the United States makes another false statement. I also used 7 seconds of video without audio to critique the segment as well (it showed the interviewer and Bush). This is in a 70 second video that I present as my news analysis. This CLEARLY falls under Fair Use. My video has been pulled off of YouTube and this notice is in its place: "This video has been removed at the request of copyright owner CBS Broadcasting, Inc because its content was used without permission" That is BS. I have a right under Fair Use to use 18 seconds of audio and 7 seconds of video to analyze an extremely important issue of the day. If what I did in this video is not "Fair Use" then nothing is.
The 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: “quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author's observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported.” copyright.gov
