Dear Sir,
I write to inform you of the abuse of copyright claims by cseministry (Creation Science Ministries).

cseministry (Creation Science Ministries) have been flagging videos as their copyrighted material even though they contain no material whatsoever from cseministry. cseministry was founded by the young earth creationist and public figure, Kent Hovind who is currently serving a 10 year jail sentence for tax fraud. Videos that cseministry have claimed infringed their copyright include phone calls from various scientists to Kent Hovind, Hovinds phone calls from jails where he conspires to hide property from the IRS and completely original satirical animations of the likeness of the public figure Kent Hovind. cseministry are evidently making abusive use of the copyright claims system by making false claims against videos which reflect badly on cseministry or their founder Kent Hovind.
-This is an abuse of the systems that cseministry have been systematically using as a form of 'back door censorship' and needs to be addressed.


Further cseministry have made copyright claims on videos they have previously made. Yet cseministry have previously declared that all material produced by their ministry is public domain material (see video below). Public domain material cannot be copyrighted. Indeed it would appear that it is only within the last week that cseministry have changed their website (drdino.com) to falsely claim they have copyright protection on all the material they have previously put in the public domain (see video below), simply so they can falsely flag videos critical of them on youtube. No-one can claim the copyright for public domain material, not even cseministry.
And even IF cseministry did own the copyright for any of this material, all of the videos they have flagged as infringing their copyright would fall into the category of fair use.

Kent Hovind/friends/family earned a whole section devoted to themselves here when "Creation Science Evangelism Ministries" sent numerous copyright take down notices to Youtube (9-07) claiming copyright ownership of material that we and many others believe is fair use within the boundaries of copyright law. In addition to 20+ videos that we can find that were removed from youtube due to copyright claims there were over a dozen others that we were able to count that were removed due to "terms of use violation" as opposed to a copyright violation. We are unsure how those videos were removed and are suspicious. Fair use law respects ones right to criticize, parody, satire, and commentate on material while utilizing material from the person who is being spoken about.

Kent Hovind has stated many times that "our material is not copyrighted." In September 2007, about the same time that "Creation Science Evangelism Ministries" sent DMCA take down notices, their website was changed to reflect a new copyright rule for their website. On their website in September of 2007 they in fact present their copyright on material effective as of January 2005. This new change to their website can be documented here. As you can see, they did not have the "clickable" copyright notice on any page of their site as of any other date!

Considering that every video we have seen that was banned would fit within fair use law and the "Creation Science Evangelism Ministries" have been very upfront about their non copyright, we believe that the actions of "Creation Science Evangelism Ministries" are meant to silence critics that can prove their unscientific statements... well... unscientific. We feel as if this act to silence us should be countered.

As a result of actions taken by "Creation Science Evangelism Ministries" we believe that it is our duty to ensure that humanity is ten times more familiar with the holes in the teachings of CSEM than they would be, were CSEM never to have submitted those take down notices. We believe that our right to free speech is the most important right we have, which has already been squandered too much over the years. This right affects all of us equally.

Our right to speak out about the irrationality of religion is the same right you are afforded to speak about exactly the opposite. We don't think people want to live in a world in which you are not afforded those rights, and so therefore this is an issue that transcends any argument either side will ever make for, or against any God. We are proud to be aware of at least one Christian who has offered to stand by our side if our facts are accurate. He understands the issue, as he's been there before.  less

This is my hommage to that wonderful man, Kent Hovind, and to those enlightened scientists at Answers in Genesis who are constantly capable of rationalising nonsense and who never give up in their fight   more...against reality, common sense and logic.
